Refund Policy

Effective Date: January 1, 2026

This Refund Policy governs all consulting and professional services provided by Ember Sky Tech ("Company," "we," "our," or "us").

By purchasing any services from Ember Sky Tech, you acknowledge and agree to the terms outlined below.

1. Nature of Services

Ember Sky Tech provides professional consulting services related to:

  • Data Engineering

  • Data Architecture

  • Data Analytics

  • Business Intelligence

  • Cloud Data Solutions

  • Data Strategy & Advisory

  • Data Governance

  • AI Readiness and Analytics Consulting

Because our services involve professional expertise, customized recommendations, strategic guidance, and intellectual work products, refund requests are evaluated according to this Policy.

2. Non-Refundable Services

Unless otherwise required by law, consulting services are generally non-refundable once work has commenced.

Non-refundable services include, but are not limited to:

  • Data strategy development

  • Data architecture design

  • Data engineering consulting

  • Analytics consulting

  • Business intelligence planning

  • Cloud migration consulting

  • Data governance assessments

  • AI readiness assessments

  • Technical workshops

  • Discovery and assessment engagements

  • Advisory and consulting services

  • Custom reports and deliverables

Once project resources have been allocated and work has begun, Ember Sky Tech incurs professional, operational, and administrative costs that cannot be recovered.

3. Refund Eligibility

Refund requests may be considered under the following circumstances:

3.1 Duplicate Payments

If a client accidentally submits multiple payments for the same invoice, the duplicate payment may be refunded after verification.

3.2 Services Not Yet Started

If no work has commenced and no resources have been assigned, a client may request a refund within seven (7) calendar days of payment.

Refund approval remains subject to review.

3.3 Inability to Provide Services

If Ember Sky Tech determines that it cannot provide the contracted services for operational reasons, we may issue a full or partial refund at our discretion.

4. Partial Refunds

If work has already begun, a partial refund may be considered based on:

  • Work completed

  • Time invested

  • Resources allocated

  • Deliverables produced

  • Administrative expenses incurred

The Company reserves the right to retain payment for services already performed.

5. Project-Based and Milestone-Based Engagements

For projects divided into phases or milestones:

  • Completed milestones are non-refundable.

  • Approved deliverables are considered accepted and earned.

  • Refund requests may apply only to future work that has not yet started.

Any completed consulting work remains billable regardless of project continuation.

6. Client Delays and Project Interruptions

Refunds will not be issued for delays, interruptions, or project suspension resulting from:

  • Failure to provide required information

  • Delayed stakeholder feedback

  • Failure to provide system access

  • Missed meetings or workshops

  • Internal organizational changes

  • Changes in project scope or priorities

7. Change of Mind

Refunds will not be granted due to:

  • Change of business priorities

  • Budget reductions

  • Internal restructuring

  • Leadership changes

  • Change of strategy

  • Change of mind after work has commenced

8. Third-Party Costs

Ember Sky Tech is not responsible for refunding expenses associated with third-party products or services, including but not limited to:

  • Cloud platforms

  • Software licenses

  • Analytics platforms

  • Data storage providers

  • Hosting services

  • External vendors

Such costs are generally non-refundable once incurred.

9. Payment Disputes and Chargebacks

Clients agree to contact Ember Sky Tech before initiating any payment dispute or chargeback.

If a dispute arises, we may provide supporting documentation including:

  • Contracts

  • Statements of Work (SOWs)

  • Invoices

  • Project documentation

  • Deliverables

  • Communication records

Fraudulent or unjustified chargebacks may result in:

  • Suspension of services

  • Termination of active engagements

  • Collection activities where permitted by law

  • Legal action if necessary

10. Refund Request Procedure

All refund requests must be submitted in writing.

Please include:

  • Client name

  • Company name

  • Invoice number

  • Date of payment

  • Amount paid

  • Detailed explanation of the request

11. Review Period

Refund requests are typically reviewed within 10 to 30 business days.

Additional information may be requested as part of the review process.

Submission of a refund request does not guarantee approval.

12. Limitation of Liability

To the fullest extent permitted by applicable law, Ember Sky Tech shall not be liable for:

  • Indirect damages

  • Consequential damages

  • Lost profits

  • Lost revenue

  • Business interruption

  • Loss of opportunity

  • Data loss

The Company's total liability shall not exceed the amount paid by the client for the specific services giving rise to the claim.

13. Final Determination

All refund decisions are made by Ember Sky Tech after review of the relevant facts and supporting documentation.

The Company's determination regarding refund eligibility shall be final, except where otherwise required by applicable law.
